Adskii Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Adskii mobile application (the "App") and our website at adskii.com (the "Website"), both operated by Adskii ("we," "us," or "our"). By downloading the App or using the Website, you agree to be bound by these Terms. If you do not agree, do not use our services.

These Terms are subject to change. Continued use of our services following any updates constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 18 years of age to use the App or Website. By using our services, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent to use our services.

2. Description of Services

A. The App

Adskii is a mobile application distributed as an Android Package (APK) file that users sideload onto their devices. The App is designed to detect and collect domain information from advertisements targeting the user's device and installed apps. The App is provided "as is" and functionality may change with updates.

B. The Website

Our Website serves as a distribution channel for the App, providing the APK download link and collecting email addresses for the purpose of delivering future App updates and promotional communications.

3. Third-Party Services and Risk

Interaction with Third-Party Services

Adskii is designed to interact with and modify the behavior of third-party applications and services on your device, including but not limited to detecting, skipping, or blocking advertisements.

You acknowledge and agree that:

• Your use of Adskii may violate the terms of service or acceptable use policies of third-party applications, such as video platforms, streaming services, or mobile apps.
• Adskii is not responsible for any consequences resulting from such interactions, including but not limited to account suspension, termination, or restricted access.
• You assume all risk associated with using Adskii in connection with third-party services.

Adskii does not monitor or enforce compliance with any third-party terms of service and disclaims any responsibility for user compliance with such terms.

No Affiliation Clause

Adskii is not affiliated with, endorsed by, or sponsored by any third-party application, platform, or service, including but not limited to Google, YouTube, or any mobile application developer. All trademarks are the property of their respective owners.

4. Sideloading the App

The App is distributed as a direct APK download, not through the Google Play Store or any official app marketplace. By downloading and installing the App, you acknowledge that:

• You are sideloading the App onto your device and accept any associated risks.
• You must enable "Install from Unknown Sources" or equivalent settings on your device.
• Adskii is not responsible for any device damage, data loss, or security issues arising from the sideloading process.
• You will install App updates at your own discretion when notified via email.

5. User Accounts and Email Registration

By submitting your email address on the Website, you:

• Consent to receive the App download link and future updated versions of the App.
• Consent to receive occasional promotional communications, referral program invitations, and special offers from Adskii.
• Represent that the email address you provide is your own and that you are authorized to use it.

You may opt out of promotional emails at any time using the unsubscribe link in any email or by contacting us. Opting out of promotions will not affect your receipt of App update notifications unless you request full removal.

6. Referral and Promotional Programs

Adskii may, from time to time, offer referral programs or promotional campaigns that reward users for sharing the App with others. Participation in any such program is voluntary and subject to the specific terms communicated at the time of the promotion. We reserve the right to modify, suspend, or terminate any promotional program at any time.

7. Acceptable Use

By using the App and Website, you agree not to:

• Use the services for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Interfere with or disrupt the integrity or performance of the App or Website.
• Attempt to gain unauthorized access to any systems or networks connected to Adskii.
• Use the App in any manner that could damage, disable, or impair the App or harm other users.
• Misrepresent your identity or affiliation when registering your email or using the services.

8. Intellectual Property

All content on the Website and within the App, including but not limited to software, text, graphics, logos, and design, is the property of Adskii or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

9. Data Collection and Privacy

Your use of the App and Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the data practices described in the Privacy Policy, including the collection of ad domain data from your device.

10. Disclaimer of Warranties

The App and Website are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. Adskii makes no representations or warranties regarding:

• The accuracy, completeness, or reliability of any content or data.
• The uninterrupted or error-free operation of the App or Website.
• The fitness of the App for any particular purpose.
• The security of data transmitted through the App or Website.

Due to the nature of third-party applications, Adskii functionality may be interrupted, degraded, or rendered ineffective at any time without notice.

Adskii makes no representation that use of the App complies with the terms, policies, or legal requirements of any third-party service.

Your use of the services is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Adskii and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App or Website, including but not limited to:

• Loss of data or device functionality resulting from sideloading the App.
• Unauthorized access to your device or personal data.
• Any reliance on information provided through the App or Website.

Our total liability to you for any claim arising from use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Adskii and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the App or Website, your violation of these Terms, or your violation of any applicable law.

13. Changes to the App and Services

Adskii reserves the right to modify, suspend, or discontinue the App or Website at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the services.

14. Business Transfers

In the event that Adskii is involved in a merger, acquisition, sale of assets, or other business transaction, these Terms and any rights or obligations hereunder may be transferred to the acquiring entity. We will notify users via email and/or a prominent notice on the Website prior to such a transfer. These Terms are subject to change in connection with any such event.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Indiana for the resolution of any disputes.

If you access or use the App or Website from outside the United States, you do so at your own initiative and are responsible for compliance with all applicable local laws and regulations. Adskii makes no representation that the App or Website is appropriate or available for use in all jurisdictions.

16. Dispute Resolution

In the event of a dispute arising from or relating to these Terms or your use of our services, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Indiana under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property claims.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Adskii with respect to your use of the App and Website and supersede all prior agreements and understandings.
